Both medical and adult-use cannabis are illegal in Idaho. Idaho has strict laws against cannabis, despite being surrounded by legal states.
Despite 60% of Idaho residents agreeing with legalization, Idaho’s lawmakers aren’t rushing to embrace this potential revenue source. State lawmakers have tried numerous times to make it harder to legalize cannabis while advocates have tried numerous times since 2012 to legalize the plant.
Most recently, there was an attempt in 2022 to get residents to vote for legal cannabis via a ballot initiative, but it failed to reach the required number of signatures.
In April 2021, the state’s legislature rejected a proposed constitutional amendment that would have made any future legalization measure require the approval of two-thirds of the legislature. In August 2021, the state’s Supreme Court struck down a new law that would have made it harder to get marijuana legalization initiatives on ballot measures before voters. Despite this, the 2022 initiative still failed.
Idaho cannabis laws
Idaho is a full prohibition state and has strict penalties surrounding cannabis. Possession of fewer than 3 ounces is a misdemeanor that carries a year in jail and a $1,000 fine. Being caught with paraphernalia is also a misdemeanor that carries the same jail time and charges. Consuming cannabis in public is also a misdemeanor with 6 months in jail and a $1,000 fine.
Everything else – possession over three ounces, intent to distribute, selling or delivering weed, and cultivation, is a felony charge with jail time ranging from 1 – 5 years and fines of $50,000.
Does Idaho have medical marijuana?
Despite 74% of Idaho residents supporting legal medical marijuana as far back as 2011, there is no medical marijuana program in Idaho.
In 2021, the state legalized the use of Epidiolex, a CBD-based medication with less than 0.1% THC.
A 2022 ballot initiative that would have created a medical cannabis program failed to gain the signatures necessary to be voted on in the fall.
CBD regulations
Despite the federal government regulating hemp and CBD products back in 2018, it wasn’t until 2021 that Idaho allowed for the cultivation and transportation of hemp and products with less than 0.3% THC. However, Idaho still does not allow the sale of these products; only CBD products with 0% THC are allowed.

No, you cannot legally buy cannabis in Idaho. The only way to get cannabis or products is through the black market, where products are untested and unregulated. Consume at your own risk.
You cannot bring cannabis products into Idaho. Not only does the state have strict punishments for doing so, crossing state lines with cannabis is federally illegal.
